Below are the Buffalo Bill Art Show & Sale’s Auctions’ terms and conditions please review all details prior to registering and participating in the auctions. Please note registration to auctions is acknowledgment of our terms and conditions.
LIVE AUCTION RULES
The auctioneer sells each work of art in the order listed in the catalog. The auctioneer begins bidding at a stated dollar amount, and when a prospective buyer bids that amount, the auctioneer then requests bids for a higher amount. This continues until no one responds to the next higher bid request. The auction pace is brisk. Approximately 15 works are sold per 1/2 hour. If you wish to bid, raise your bid number high to be sure your bid is recognized. Do not be shy! Live auctions close by announcement of the auctioneer.
SILENT AUCTION RULES
To purchase silent auction artwork, guests enter their bid amount and bid number in writing on the bid sheets posted beside each silent auction piece. The minimum increase is $50. Silent auctions both Friday and Saturday close exactly 15 minutes following the conclusion of the live auctions. In cases of heated bidding in the closing minutes of the silent auction, auctioneers may convert the silent auction to live bidding between/among the involved parties on select pieces to conclusion.
QUICK DRAW SCULPTURE RULES
Shipping charges for Quick Draw sculptures will be paid by the buyer.
BID NUMBERS
Bid numbers are automatically assigned to preregistered guests. Bid numbers are located on the reverse side of guest name tags/tickets and are issued at the show’s registration station. Use the same bid number and name tag/ticket for both the Friday and Saturday auctions.
ABSENTEE BIDS
If you are unable to attend the auctions in person and wish to place bids, you may submit absentee bids to be executed by Buffalo Bill Art Show representatives. Bid forms are available by calling (307) 587-5002 or (307) 587-2777 or visiting our Web site at www.buffalobillartshow.com.
SETTLEMENT
After each item’s sale, the successful bidder immediately signs a sale contract, provided directly to him or her. Successful bidders pay the final bid price for their item(s) during or immediately following the auctions by presenting their copy of the sale contract at the cashier station. Purchases made by cash or check generate more support for the cause and is appreciated. Cashiers are located in the Party Tent. Buyers may pay by cash, check, or credit card. Checks are made payable to the Buffalo Bill Art Show. MasterCard, Visa, American Express and Discover are accepted. The buyer retains one copy of the sale contract (orange copy). Please Note: a 15% buyer’s premium is added to the final bid price. All sales are final and there are no exchanges or refunds on items. To protect buyers and ensure the safety of the artwork, all buyers taking artwork from the events must present proof of purchase (orange copy of the sale contract form) at the time of their departure.
SHIPPING
We prefer that buyers obtain artwork purchases directly following the auction (if purchases are not intended for shipping). Otherwise, artwork is available for pick up beginning Monday, September 26th at the Cody Country Chamber of Commerce, 836 Sheridan Ave., Cody, Wyoming. Shipping arrangements are made at the time of settlement and buyers are responsible for shipping costs. The UPS Store is the official shipper of the Buffalo Bill Art Show & Sale, however, other options are available to patrons for “White Glove” Service at an additional cost.
TAX DEDUCTIBILITY
According to IRS Rules and Regulations, the only tax deduction for the purchase of auction items from non-profit organizations is the amount paid in excess of fair market value. We suggest that you contact your tax professional to determine the tax deductions (if any) for your specific purchase(s).
CONDITIONS OF SALE
The property available at the Buffalo Bill Art Show & Sale will be offered and sold by the Cody Country Chamber of Commerce (“Chamber”) as agent for the “consignor” under the following terms and conditions: The Chamber reserves the right to withdraw any artwork at any time before the actual sale. If the auctioneer determines that any opening bid is not commensurate with the artist’s reserve value of the article offered, he may reject that offer and withdraw the article from sale; and if having acknowledged an opening bid, the auctioneer decides that any advance thereafter is not of sufficient amount, he may reject the advance. The highest bidder acknowledged by the auctioneer shall be the purchaser. In the event of any dispute between bidders, the auctioneer shall have sole and final discretion either to determine the successful bidder or to re-offer and re-sell the article in dispute. If any dispute arises after the sale, the Chamber’s sale records shall be conclusive in all respects. Unless otherwise announced by the auctioneer at the time of sale, all bids are per lot as numbered in the catalog. With the fall of the auctioneer’s gavel or, in the case of the Silent Bid pieces, the acceptance of the successful silent bid and a signed confirmation of purchase, title will pass to the highest bidder, who will pay the full purchase price thereof, plus a 15% buyer’s premium. As title to the piece passes to that buyer, the buyer thereupon assumes risk and responsibility thereof. All artwork shall be removed by the purchaser or shipped at the purchaser’s expense. Unless the sale is advertised and announced as a sale without reserve, each lot is offered subject to reserve. The consignor may bid upon its property as well as upon any other property offered. Please Note: a 15% buyer’s premium is added to the final bid price. In all instances, the copyright remains the property of the artist.
